TERMS & CONDITIONS FOR FLOORING DERBYSHIRE LTD

Whilst there is a lot of material to digest, we’ve tried to make it as readable as possible in order to give you the best understanding of our processes.
The following conditions express our commitment to you and outline the expectations of Flooring Derbyshire Ltd and our installation team, in order to achieve the smoothest possible experience for all involved. Although some of the material below may not directly relate to your purchase, it is definitely worth having a read through, as there may be some useful information regarding your new flooring, the fitting process and warranties. The following terms and conditions do not affect your statutory rights. If there is something not covered in the following document, please do not hesitate to contact us with your query.

QUOTATIONS
​
You’ll be glad to know that once we submit a quote to you, this is valid for 30 days. If you wish to accept our quote, you will be required to pay a 50% deposit in order to secure dates and to order materials. All of our projects are bespoke orders, so whilst we try our best to order your flooring directly from our approved manufacturers in time, we cannot be held responsible for production or logistics delays from the manufacturer. If there are any delays, we will endeavour to communicate with you as soon as possible to rearrange fitting dates.
Please note that during site surveys we can only account for what we can see. We’ll do our best to assess conditions for areas that have existing floor-coverings in situ and advise solutions for areas that have no sub-floor. Despite a wealth of experience, we cannot guarantee that our initial assessment is correct when subfloor coverings are still in place. Therefore, we cannot be held accountable for amendments to costs or materials required to carry out the job to the standard required. We will discuss any changes with you before we do so and we’re also happy to conduct a second survey if needed, especially when building works have been carried out that join multiple areas with different subfloor conditions or involve the laying of a new slab. Likewise, if after we have surveyed you make changes to adjoining floors, subfloor heights or materials used, it is important that you inform us as we may need to alter the subfloor products we use. Failure to notify us of post-survey changes may result in additional costs, to be absorbed by the customer.

SUBFLOORS
​
Where sub floors need smoothing using screeding materials or ply board, it cannot be guaranteed that existing undulations or changes in subfloor heights will not still be noticeable. This may be more so between different types of subfloor (wood and concrete) or where walls have been removed. Thin resilient materials such as Moduleo, Karndean, Amtico, or linoleum, may show contours especially in strong light. Unless agreed at the quotation stage, the quote does not include floor levelling.

DOORS & PLINTHS
​
If the floor heights change and there is not enough clearance for doors and plinths, we can offer a trimming service. This is usually identified at the survey stage and noted in your quote.
WARRANTIES
​
We’re very proud of the products we use and the manufacturers we source them from. Typically, goods will come with a manufacturer’s guarantee or warranty. For more information with regards to the guarantee on specific products, either follow the warranty information on the manufacturer’s website, or contact us directly for more information. If required by the manufacturer, it is important to complete the warranty registration to validate it. With regards to labour, our service guarantee is to cover workmanship and is limited to 12 months from installation date. These guarantees are void if the flooring is subject to negligence, misuse, improper maintenance, and if repairs or alterations have been carried out by anyone other than an agent of Flooring Derbyshire Ltd.

PAYMENT
​
Until full payment has been received by Flooring Derbyshire Ltd all goods on the order will remain the property of the company. The legal title of the goods shall remain the property of the company until any monies whatsoever which are owing to the company by the customer and repossess the goods in the event of non-payment of an outstanding balance. Payment is due on the day of completion.

CANCELLATIONS
​
Orders can only be cancelled without penalty prior to the despatch of goods from our suppliers. Thereafter, it is likely that cancellations and returns will be subject to re-stocking fees and courier costs at a rate of 30%, to be deducted from deposits. No cancellations or returns can be made for orders where materials such as carpets have been cut or when products have been made to order. We have a strict no returns policy for goods ordered on a supply-only basis – it is the customer’s (and/or their installer’s) responsibility to check that the requirements are correct prior to confirming the order.

FITTING
​
The installation dates we commit to are given in good faith and these almost always go ahead as planned, but in the event of any delay, one of the Flooring Derbyshire team will contact you as soon as possible to inform you and to find a suitable solution. We do not accept responsibility for, nor can be compensate for delays when they are beyond our control (such as manufacturing setbacks or external delivery problems).
We assume responsibility for the quality of and relevant arrangements of installation. Our installers are all employees of Flooring Derbyshire Ltd, highly trained and experienced. Our installers look to undertake the work with care, but even with the greatest attention to detail, there is a chance that décor may be scuffed during installation. This is especially possible with large, heavy carpets. New paintwork is particularly vulnerable and should be allowed to fully cure (a minimum of 2 weeks is recommended). We are happy to deliver carpets to site before decorating commences in order to reduce the risk of marking walls. Unless through negligence, Flooring Derbyshire will not accept responsibility to any re-decoration.
It’s really important that you highlight any concealed pipes or cables to our installation team, as we cannot be held accountable in the event of accidental damage to hidden or hard to see pipes or cables. Please bring to our attention the use of any existing or proposed underfloor heating system, as we’ll need to make sure that the subfloor materials and flooring materials chosen are suitable.
For installations to commence as agreed, there should be adequate parking, good access, and provisions for water and electricity. Areas should be clear of building materials and tools.
We require that our installers are the only people working in the areas. Other contractors may impede our performance, affecting both the length of time the work will take and the quality of the work. If the area is not clear, ready and workable on the day of installation, you may be subject to additional costs.

FURNTIURE & ACCESS
​
Unless otherwise agreed, rooms must be free of furniture and existing flooring. If you would like help moving furniture from your room, we are happy to help with this, but please let us know in advance; larger items may require us to bring an additional person and there may be an additional cost for this. We ask that you get any room where flooring is to be installed as empty as possible. Any items that cannot be moved out completely must be emptied (e.g. a sideboard full of glasses). We do not accept any liability for breakages where it would have been possible for the items to be removed prior to us arriving to install the flooring. We offer uplift, disposal and furniture moving, but these require notice and are chargeable. If you require these services, please inform us at the time of ordering.

APPLIANCES
​
The client is responsible for any disconnection, moving and reconnection of all domestic plumbed, gas and electrical appliances. If we are required to undertake this work, we reserve the right to charge. No responsibility can be accepted in respect of this work.

AFTERCARE
​
After care of floors is the responsibility of the customer. We leave you with our Care & Maintenance Guide which gives you essential advice on how to care for your floor. For more detailed advice, please refer to the manufacturer’s warranty guidelines, or contact us if you have any queries. We cannot be held responsible for damage caused to the floor by the use of improper cleaning (such as strong detergents, chemicals or corrosives, or the use of steam mops), or stains transferred from other materials such as mats. Any flooring material can be prone to damage, so we encourage you to protect it from damage caused by casters on furniture, impacts from heavy or sharp objects, narrow or spiked heels, and damage from unprotected furniture legs. Responsibility cannot be accepted for fading or discoloration to flooring products due to excessive, unobstructed sunlight. Discolouration can also occur from latex or rubber-backed floor mats or rugs.
